وهنا مسألة يتكلم عنها الفقهاء كثيراً، وهي: هل وجوب الحج على الفور أم على التراخي؟ وقد اختلف الفقهاء في هذه المسألة فمنهم من قال بالوجوب على الفور، وهم أصحاب المذاهب الثلاثة الحنابلة والحنفية المالكية، واستدلوا بأدلة منها:- قوله تعالى: :{وَلِلّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلاً}(97) سورة آل عمران. وحديث: (تعجلوا إلى الحج يعني الفريضة فإن أحدكم لا يدري ما يعرض له)(10).وحديث: (من لم يحبسه مرض أو حاجة ظاهرة أو مشقة ظاهرة أو سلطان جائر فلم يحج فليمت إن شاء يهودياً، وإن شاء نصرانياً)(11). رواه أحمد ورواية الترمذي: (من ملك زاداً وراحلة تبلغه إلى بيت الله، ولم يحج فلا عليه أن يموت يهودياً أو نصرانياً؛ وذلك لأن الله قال في كتابه: (ولله على الناس حج البيت من استطاع إليه سبيلاً).(آل عمران:97)(12).
وروى سعيد بن منصور في سننه، والبيهقي عن عمر بن الخطاب أنه قال: (لقد هممت أن أبعث رجالاً إلى هذه الأمصار فينظروا كل من كان جدة (أي سعة من المال). ولم يحج ليضربوا عليهم الجزية، ما هم بمسلمين ما هم بمسلمين)(13).
وقال الشافعية وأحمد والحنفية: بوجوب الحج على التراخي، قالوا: ويجوز أن يؤخره من سنة إلى سنة، لأن فريضة الحج نزلت على المشهور عندهم سنة ست، فأخر النبي صلى الله عليه وسلم إلى سنة عشر من غير عذر، و الرأي الأول قوي لدلالة الأحاديث السابقة وإن كان في بعضها ضعفٌ. ولسنا بصدد ذكر أدلة الفريقين والرد عليها. وإنما ذكرنا هذه المسألة بشيء من الاختصار؛ لأن المقال لا يسع ذلك.

من أنكر فرضية الحج فهو كافر مرتد عن الإسلام إلا أن يكون جاهلاً وهو ممن يمكن جهله بهذا الحكم كحديث عهد بإسلام، وناشئ في بادية بعيده لا يعرف من أحكام الإسلام شيئاً، فهذا يُعذر بجهله ويُعرَّف، ويُبين له الحكم، فإن أصر على إنكاره حُكم بردته.

قال الشيخ ابن عثيمين رحمه الله: وأما شروط وجوب الحج والعمرة فخمسة مجموعة في قول الناظم:
الحج والعمرة واجبان في العمر مرة بلا توان
بشرط إسلام حرية عقل بلوغ قدرة جلية

أولاً: الإسلام فغير المسلم لا يجب عليه الحج، بل ولا يصح منه لو حج، بل ولا يجوز له دخوله مكة لقوله تعالى:{يَا أَيُّهَا الَّذِينَ آمَنُواْ إِنَّمَا الْمُشْرِكُونَ نَجَسٌ فَلاَ يَقْرَبُواْ الْمَسْجِدَ الْحَرَامَ بَعْدَ عَامِهِمْ هَذَا}(28) سورة التوبة.

ثالثاً: البلوغ: فمن كان دون البلوغ فإنه لا يجب عليه، لكن لو حج فإن حجه صحيح، ولكن لا يُجزئه عن حجة الإسلام لقول النبي صلى الله عليه وسلم للمرأة التي رفعت إليه صبياً وقالت: (ألهذا حج؟ قال نعم ولك أجر)14. لكنه لا يُجزئه عن حجة الإسلام، لأنه لم يُوجَّه إليه الأمر بها. حتى يجزئه عنها، ولا يتوجه الأمر إليه إلا بعد البلوغ.
يقول الشيخ ابن عثيمين رحمه الله تعالى: وبهذه المناسبة أحب أن أقول: إنه في مثل المواسم التي يكثر فيها الزحام ويشق فيها الإحرام للصغار ومراعاة إتمام مناسكهم، الأولى ألا يحرموا بحج ولا عمرة؛ لأنه يكون فيه مشقة عليهم وعلى أولياء أمورهم، وربما شُغلوا عن إتمام مناسكهم، فيبقوا في حرج، وما دام الحج لم يجب عليهم، فإنهم في سعة من أمرهم.
رابعاً: الحرية: فالرقيق المملوك لا يجب عليه الحج، لأنه مملوك مشغول بسيده، فهو معذور بترك الحج لا يستطيع السبيلَ إليه.
خامساً: القدرة على الحج بالمال والبدن: فإن كان الإنسان قادراً بماله دون بدنه، فإنه يُنيب من يحج عنه
لحديث ابن عباس -رضي الله عنهما- قال:كان الفضل رديف رسول الله -صلى الله عليه وسلم- فجاءت امرأة من خثعم فجعل الفضل ينظر إليها وتنظر إليه، وجعل النبي -صلى الله عليه وسلم- يصرف وجه الفضل إلى الشق الآخر، فقالت: يا رسول الله إن فريضة الله على عباده في الحج أدركت أبي شيخاً كبيراً لا يثبت على الراحلة أفأحج عنه. قال نعم). وذلك في حجة الوداع.(15). ففي قولها: أدركته فريضة الله على عباده في الحج، وإقرار النبي صلى الله عليه وسلم إياها على ذلك دليل على أن من كان قادراً بماله دون بدنه، فإنه يجب عليه أن يُقيم من يحج عنه. أما مَن كان قادراً ببدنه دون ماله، ولا يستطيع الوصول إلى مكة ببدنه، فإن الحج لا يجب عليه.
